Roughly 92 years, 3 months, and 13 days not a moment longer. That’s how long Suppressors, SBRs, SBSs, and AOWs have stayed on the National Firearms Registry. The registry tracks their flow and imposes a $200 stamp on every registration. While not very complicated, the path to acquiring these items proved a thorn for firearm owners. The process burdened many owners for years. Wait times for forms to come back were grueling. The entire process was painful. This writer avoided it as a result.
The First Major Victory Removal of Tax-Stamp.

Over the last few years, various groups have chipped away at the NFA (National Firearms Act)to grant broader freedoms. To the entire 2A community the first big victory came with the removal of the 200$ tax-stamp required that came with the OBBB(One Big beautiful bill act). Below you’ll find the direct language from the bill.
“SEC. 70436. REDUCTION OF TRANSFER AND MANUFACTURING TAXES FOR CERTAIN DEVICES.(a) Transfer Tax.—Section 5811(a) is amended to read as follows:“(a) Rate.—There shall be levied, collected, and paid on firearms transferred a tax at the rate of—“(1) $200 for each firearm transferred in the case of a machine gun or a destructive device, and“(2) $0 for any firearm transferred which is not described in paragraph (1).”.(b) Making Tax.—Section 5821(a) is amended to read as follows:“(a) Rate.—There shall be levied, collected, and paid upon the making of a firearm a tax at the rate of—“(1) $200 for each firearm made in the case of a machine gun or a destructive device, and“(2) $0 for any firearm made which is not described in paragraph (1).”.(c) Conforming Amendment.—Section 4182(a) is amended by adding at the end the following: “For purposes of the preceding sentence, any firearm described in section 5811(a)(2) shall be deemed to be a firearm on which the tax provided by section 5811 has been paid.”139 STAT. 248 ” United States, Congress. One Big Beautiful Bill Act, Public Law 119-21, 4 July 2025. Congress.gov, www.congress.gov/bill/119th-congress/house-bill/1.
This outlines the removal of such tax that took place as of January,1,2026. The Silencer Shop foundation used this as the basis to file the there lawsuit.
The Latest Victory

Only 281 days after the first major victory, the second has come, thanks to the valiant efforts of the Silencer Shop Foundation. They chose to stand tall and fight using sound logic and reason. The Gist of the lawsuit is that if Congress can no longer collect tax revenue from the $200 tax stamp. The entire system should be done away with, meaning the NFA’s grasp on everything except machine guns & destructive devices. No Rambo Muchachos … Yet, for everyone else, the suppressors, short-barreled rifles, short-barreled shotguns (Rip Ruby Ridge victims of The Weaver family), and Any Other Weapons. Those no longer require forms. You only need the basic 4473 to transfer from FFL dealers to you, just like when you buy a firearm. The real question is: since most guns can be privately sold with no 4473 required, is it possible to now buy these items from private parties? Are we entering the age of Freedoms for the 2A community? This writer wonders how long before society bites the hand that feeds it. Meaning, how long until a catastrophe occurs with an NFA weapon, excluding the ones still under its purview? For now, a celebration is in order also; it’s time to stock up on all the NFA items you have been putting off. Don’t delay. The clock is ticking until the ATF changes its mind or feels pressure to revert to its old ways, grandfathering in anyone smart enough to take advantage of this gift.
“Although the district court’s injunction applies only to plaintiffs and certain other specified
persons, the Department has determined to exercise its enforcement discretion to create greater
uniformity, consistent with the Attorney General’s statement today. Consequently, effective
October 9, 2026, ATF will no longer require individuals to seek ATF approval under the NFA
before making or transferring short-barreled rifles, short-barreled shotguns, silencers, and “any
other weapon[s]” as defined in 26 U.S.C. § 5845(e). ATF will also no longer require such items
to be registered in the National Firearms Registration and Transfer Record. These policies apply
uniformly to anyone otherwise subject to these requirements, not just to the plaintiffs in the
litigation.”
What Remains After this Victory
I implore you to read the guidance letter in its entirety because it’s a major victory, but there’s still a lot to do to ensure the basic freedoms the Second Amendment laid out. If you are like me, a gun owner/enthusiast, you might be wondering: now that I can buy NFA items as easily as using a 4473, that’s amazing. But are the other regulations regarding those NFA items still in place? This is such a fluid situation right now that it may take a few months before states start amending their laws to meet current Federal Guidance. Right now, it feels like a free-for-all; everyone is jumping at the chance to obtain NFA items using Form 4473. But most states still have strict ownership/possession requirements for those items, stemming from the federal guidance on the matter that was just amended on Oct. 9, 2026. As a Florida resident whose state has historically sided with the 2A community, there is no fear of the state attempting to inhibit me from getting anything.
